These Terms and Conditions (“Terms”) govern your use of the Caps and Seals website and your
purchase of products from us. By accessing our website or placing an order, you agree to be
bound by these Terms. If you do not agree, you should not use our website or purchase our
products.
2. Definitions

- “Goods” means the products supplied by Caps and Seals.

- Caps and Seals makes reasonable efforts to ensure that product information is accurate, but we do not warrant that descriptions, images, or details are error-free.

4. Orders

5. Payment Terms
- Payment must be made in full prior to dispatch unless otherwise agreed in writing.
- Caps and Seals reserves the right to ask to ask ongoing major suppliers for an application for a credit account which will include trade references
- Accepted payment methods include [EFT and direct deposit].
- Invoices not paid by the due date may incur interest charges at the rate permitted by law, plus recovery costs.
6. Shipping and Delivery
- Delivery times provided are estimates only. Caps and Seals will not be liable for delays outside our reasonable control.
- For items in stock, shipping is usually 2-3 business days
- For up to 3 cartons that are not in stock, shipping is usually up to 10 business days. Express Postage charges may apply.
- For pallets and large orders that are not in stock, shipping can take up to 3 months depending on the supplier.
- For bespoke and custom orders including custom capseals, shipping varies.
- Risk of loss or damage passes to the Customer once Goods are delivered to the address specified.
- Customers are responsible for providing accurate delivery details and ensuring someone is available to receive the Goods.
7. Returns and Refunds
- Caps and Seals complies with the Australian Consumer Law (ACL). Customers are entitled to a replacement, repair, or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
- If the Goods are faulty, damaged, or not as described, you must notify us within 5 business days of receipt.
- Returns will not be accepted for change of mind or incorrect orders unless agreed at our discretion.
- Returned Goods must be unused, in their original packaging, and accompanied by proof of purchase.
8. Warranties
- Except as required under the ACL, Caps and Seals excludes all express or implied warranties regarding the Goods.
- Our liability is limited to the extent permitted by law, and at our option, to:
a) replacing or resupplying the Goods; or
b) refunding the purchase price.
9. Limitation of Liability
- To the maximum extent permitted by law, Caps and Seals is not liable for indirect, incidental, special, or consequential damages arising out of the use of our website or Goods.
- Nothing in these Terms excludes or limits your statutory rights under the ACL.
10. Intellectual Property
- All content on this website, including text, images, logos, graphics, and product descriptions, is the property of Caps and Seals and is protected under intellectual property laws.
- You may not copy, reproduce, or distribute any website content without prior written consent.
11. Website Use
- You must not use the website for any unlawful purpose or in a way that may damage or impair its function.
- Caps and Seals does not guarantee that the website will be free from errors, viruses, or interruptions.
